ShortPulse Terms of Service

These Terms of Service ("Terms") govern your access to and use of ShortPulse, including our websites, applications, AI Studio tools, media library, project workspace, billing features, support features, and related services (collectively, the "Service").
By creating an account, subscribing, buying credits, uploading media, generating content, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who We Are
"ShortPulse," "we," "us," and "our" refer to Arc Creative Enterprises LLC, doing business as ShortPulse, the operator of the Service.

2. Eligibility
You must be at least 18 years old and able to enter into a binding agreement to use ShortPulse. You may use ShortPulse only for lawful purposes and only in accordance with these Terms.
If you use ShortPulse for a business, organization, client, or other entity, you represent that you have authority to bind that entity to these Terms.
3. Your Account
You are responsible for your account, credentials, prompts, uploads, generated content, billing choices, workspace activity, and all activity under your account.
You agree to provide accurate account information, keep your login credentials secure, and notify us promptly if you believe your account has been compromised.
We may require account authentication, media-rights confirmation, billing verification, or other checks before allowing access to protected routes, storage, generation tools, or account features.
4. Subscriptions, Credits, Storage, And Billing
ShortPulse may offer paid subscriptions, one-time credit packs, recurring storage add-ons, and other paid features. Payments are processed by third-party payment processors such as Stripe. You authorize us and our payment processors to charge your payment method for purchases, recurring subscriptions, applicable taxes, and other charges you approve.
Subscriptions renew automatically unless canceled through the account billing controls, Stripe Billing Portal, or another cancellation path we make available. Before you buy a recurring subscription, the checkout or pricing flow should disclose the plan, price, billing interval, renewal behavior, and cancellation path. After purchase, you can manage or cancel eligible Stripe-managed subscriptions through the secure billing controls we provide.
Canceling a subscription stops future renewals according to the active billing configuration. Unless the product flow, Stripe configuration, applicable law, or our Refund Policy says otherwise, canceling does not automatically refund past payments, current-period charges, one-time credit packs, storage add-ons, taxes, or already-used credits. You may generally keep paid subscription access through the end of the paid period when the cancellation is scheduled at period end. Immediate cancellation, payment failure, chargeback, fraud, abuse, or Terms violations may end access sooner.
Paid plans may include recurring credits, storage capacity, and active-generation limits. Credit packs are one-time top-ups. Credits are used for AI generation and related billable actions. Credit debit amounts may vary by model, workflow, settings, provider costs, and the active ShortPulse pricing policy.
Prices, plan names, credit quantities, storage limits, taxes, add-ons, and included features may change for future purchases. Existing subscriptions may keep subscriber-specific terms when ShortPulse's billing records or Stripe configuration support that treatment.
Credits are not cash, stored value, gift cards, banked money, cryptocurrency, or a deposit account. Credits are not transferable except where we expressly allow it. Credits may be reserved, released, captured, restored, reduced, or adjusted according to our generation billing rules and Refund Policy.
Our Refund Policy explains when payments, subscriptions, add-ons, and credits may or may not be refundable.
5. Your Content
"Your Content" means prompts, text, images, videos, audio, voice samples, likeness materials, files, references, project materials, media-library items, issue reports, profile information, and other material you submit, upload, store, generate, or provide through ShortPulse.
You retain whatever rights you already have in Your Content. You grant ShortPulse a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, reproduce, modify, create technical derivatives of, and otherwise use Your Content as needed to provide, secure, support, improve, and operate the Service. This includes sending Your Content to service providers and AI model providers when needed to perform the actions you request.
ShortPulse does not currently use your private workspace content to train ShortPulse-owned foundation models. We may use account data, usage data, logs, support reports, provider status, safety events, aggregated information, and deidentified information to operate, secure, debug, measure, and improve ShortPulse. That kind of product improvement is different from training a public or foundation AI model on your private content. Our Privacy Policy explains this in more detail.
You represent and warrant that:
- you own Your Content or have all rights, licenses, consents, and permissions needed to use it in ShortPulse;
- if real people appear in or are identifiable from Your Content, you have any consent required to use that content;
- if minors appear in Your Content, you have any required parent or guardian permission;
- you have the legal rights and consents required to clone, synthesize, imitate, upload, or use any voice, likeness, image, video, audio, identity material, brand, product, or client material;
- Your Content and your use of the Service will not violate law, infringe rights, invade privacy, mislead others, impersonate anyone, exploit anyone, or violate these Terms.
6. AI Outputs And Commercial Use
"Output" means images, videos, audio, text, prompts, style descriptors, generated voices, generated media, and other material generated or returned by ShortPulse or third-party AI providers based on Your Content or your use of the Service.
As between you and ShortPulse, and to the extent permitted by law, your input rights, third-party rights, and our provider agreements, ShortPulse does not claim ownership of Output merely because it was generated through ShortPulse.
Plain English: you may use Output for commercial purposes, including client work, ads, social posts, product mockups, campaigns, and monetized content, if you have the rights, permissions, consents, releases, and legal basis required for that use. ShortPulse gives you access to creative tools; it does not clear copyright, trademark, publicity, privacy, union, guild, music, model-release, platform, advertising, or client-approval rights for you.
You may not commercially use Output in a way that violates law, provider rules, platform rules, third-party rights, these Terms, or required AI disclosure obligations. You are responsible for reviewing Output before using, publishing, selling, distributing, advertising, or relying on it.
AI systems can produce inaccurate, offensive, infringing, non-unique, unsafe, misleading, or unusable Output. Similar or identical Output may be generated for other users. ShortPulse does not guarantee that Output is unique, copyrightable, protectable, non-infringing, commercially usable, platform-compliant, legally compliant, acceptable to social platforms, acceptable to ad platforms, or fit for any particular purpose.
You are responsible for disclosing AI-generated or AI-altered content when required by law, platform rules, advertising rules, election rules, consumer-protection rules, professional obligations, or your relationship with clients, audiences, or third parties.
7. Third-Party Services And Providers
ShortPulse uses third-party services for hosting, authentication, storage, payments, AI generation, voice generation, video generation, image generation, analytics, logging, tutorials, operations, and support.
These providers may include Supabase, Stripe, OpenAI, Fal, Kie.ai, ElevenLabs, Vercel, YouTube, and similar infrastructure, model, payment, hosting, and operations providers.
When you use ShortPulse, Your Content, account data, billing data, technical data, and Output may be processed by these providers as needed to provide the Service. Your use of certain features may also be subject to provider terms, acceptable-use policies, safety rules, technical limits, and destination-platform policies.
We are not responsible for third-party services that we do not control. Provider outages, rate limits, policy changes, model changes, safety filters, processing failures, or delayed responses may affect ShortPulse features.
8. Prohibited Uses
You may not use ShortPulse to:
- violate any law, regulation, contract, platform rule, provider rule, or third-party right;
- upload, generate, or distribute content you do not have rights or consent to use;
- infringe copyright, trademark, trade secret, privacy, publicity, contract, confidentiality, or other rights;
- impersonate, deceive, defraud, harass, threaten, exploit, blackmail, or harm anyone;
- clone, imitate, synthesize, or use a person's voice, likeness, identity, appearance, or persona without required permission;
- create or distribute sexual, exploitative, abusive, grooming, or deceptive content involving minors, including AI-generated or altered content;
- create or distribute non-consensual intimate imagery, sexual deepfakes, nudification, unauthorized sexualized likenesses, or intimate-image abuse;
- create fake endorsements, fake testimonials, deceptive ads, scams, phishing, credential theft, fraud, government impersonation, business impersonation, or synthetic-person deception;
- create robocalls, robotexts, voter suppression, political impersonation, synthetic campaign deception, or misleading public-interest content without all required consent, authority, and disclosures;
- generate malware, exploit code, spam, scraping, circumvention, service interference, or other harmful technical content;
- bypass, disable, overload, probe, scrape, reverse engineer, or interfere with ShortPulse, its security controls, billing controls, rate limits, provider controls, or infrastructure;
- use ShortPulse to provide regulated professional advice as final advice without qualified professional review;
- resell, sublicense, rent, or provide managed access to ShortPulse except under an approved written agreement;
- evade provider policies, model safety systems, platform disclosure rules, or these Terms.
We may block, remove, restrict, preserve, report, or refer content or activity that we believe violates these Terms, provider rules, law, or user safety.
9. Media, Voices, Likenesses, And Personal Rights
ShortPulse includes tools that can process and generate images, video, audio, voices, likenesses, character references, style references, and other media.
You are solely responsible for obtaining and keeping any rights, licenses, permissions, releases, consents, and approvals needed for your media, prompts, references, voice samples, likenesses, and Output.
You may not use ShortPulse to create, clone, alter, or distribute a voice, face, body, identity, character, brand, product, or other protected material in a way that violates someone's rights, misleads people, sexualizes someone without consent, exploits a minor, or breaks applicable law.
10. Public Sharing And Exported Content
ShortPulse is designed as a private creative workspace by default. If you export, publish, distribute, share, sell, advertise, or otherwise use Your Content or Output outside ShortPulse, you are responsible for that use and for complying with all laws, contracts, provider terms, platform rules, advertising rules, AI disclosure rules, and third-party rights.
If ShortPulse later offers public sharing, galleries, profiles, community features, collaboration, marketplace features, or public hosted UGC, additional terms, reporting paths, moderation rules, takedown procedures, and safety controls may apply.
11. Data And Privacy
Our Privacy Policy explains how we collect, use, share, retain, and protect information. By using ShortPulse, you acknowledge that we will process information as described in the Privacy Policy.
12. Service Changes, Availability, And Beta Features
ShortPulse is evolving. We may add, change, suspend, remove, or discontinue features, models, routes, providers, prices, credits, limits, storage rules, safety systems, and workflows.
Some features may be experimental, in beta, provider-dependent, or pre-launch. They may be inaccurate, unavailable, changed, rate-limited, or discontinued without notice.
We do not guarantee uninterrupted availability, successful generation, permanent storage, error-free operation, or compatibility with every browser, device, provider, platform, or use case.
You are responsible for keeping your own backups of important prompts, media, Output, exports, invoices, and project materials. ShortPulse should not be your only copy of important content.
13. Account Suspension And Termination
We may suspend or terminate your access to ShortPulse if we believe you violated these Terms, created legal or safety risk, abused the Service, failed to pay, caused chargebacks or payment disputes, violated provider rules, or used the Service in a way that could harm ShortPulse, users, providers, or third parties.
You may stop using ShortPulse at any time. Canceling a subscription stops future subscription billing according to the cancellation path and billing configuration, but it does not automatically delete all account data, media, logs, invoices, legal records, or operational records.
If your account is suspended, terminated, canceled, inactive, over storage limits, or unpaid, access to some content or features may be limited. We may retain records where needed for billing, tax, fraud prevention, security, legal compliance, dispute handling, and legitimate business operations.
14. Intellectual Property
ShortPulse, including its software, designs, interfaces, workflows, documentation, logos, names, brands, and underlying technology, is owned by ShortPulse or its licensors and is protected by intellectual-property and other laws.
These Terms do not give you ownership of ShortPulse, our software, our brand, our documentation, our model integrations, our pricing systems, our admin tools, or our infrastructure.
You may not use the ShortPulse name, logo, brand, or product assets in a way that suggests endorsement, partnership, or sponsorship without permission.
15. Feedback
If you send us feedback, suggestions, bug reports, ideas, feature requests, or other comments, you allow us to use them without restriction or compensation to you.
16. Copyright And Rights Takedown Requests
If you believe content in ShortPulse infringes your copyright or other rights, contact us at service@shortpulse.co with enough information for us to review the request.
Copyright notices should include:
- your physical or electronic signature;
- identification of the copyrighted work you claim was infringed;
- identification of the material you claim is infringing and information reasonably sufficient for us to locate it;
- your contact information;
- a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.
Counter-notices should include:
- your physical or electronic signature;
- identification of the material removed or disabled and where it appeared before removal;
- a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled because of mistake or misidentification;
- your name, address, telephone number, and consent to the jurisdiction required by 17 U.S.C. 512(g);
- a statement that you will accept service of process from the person who sent the original notice or that person's agent.

DMCA safe-harbor protection requires a qualifying service provider to publish designated-agent contact information and register the same agent information with the U.S. Copyright Office's online DMCA Designated Agent Directory. This Terms page provides ShortPulse's copyright intake path, but ShortPulse should not claim registered DMCA safe-harbor status until the operator completes and maintains the Copyright Office registration.
We may remove or disable access to material alleged to infringe rights, notify the affected user where appropriate, process counter-notices where legally required, terminate repeat infringers, and preserve records needed for legal compliance, safety, fraud prevention, or dispute handling.
You may also report non-consensual intimate imagery, child-safety concerns, impersonation, privacy violations, or other abuse at service@shortpulse.co.
17. Disclaimers
ShortPulse is provided "as is" and "as available."
To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, availability, and reliability.
We do not warrant that ShortPulse, any AI model, any provider, or any Output will meet your needs, comply with every law or platform policy, produce desired results, remain available, or be free from errors, harmful content, security issues, or data loss.
18. Limitation Of Liability
To the maximum extent permitted by law, ShortPulse and its owners, operators, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, business, goodwill, revenue, content, credits, Output, or opportunity.
To the maximum extent permitted by law, our total liability for any claim related to the Service or these Terms will not exceed the amount you paid to ShortPulse in the three months before the event giving rise to the claim, or $100, whichever is greater.
Some jurisdictions do not allow certain limitations, so some limits may not apply to you.
19. Indemnity
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless ShortPulse and its owners, operators, affiliates, service providers, and licensors from claims, damages, liabilities, losses, costs, and expenses arising from:
- Your Content;
- your Output or use of Output;
- your use or misuse of ShortPulse;
- your violation of these Terms;
- your violation of law, provider terms, platform rules, or third-party rights;
- your billing disputes, chargebacks, or unauthorized use of payment methods, except to the extent caused by ShortPulse's own unlawful conduct.
20. Governing Law And Dispute Resolution
These Terms and any disputes relating to them or the Service are governed by the laws of the State of Arizona, excluding its conflict-of-law rules.
The state and federal courts located in Maricopa County, Arizona will have exclusive jurisdiction over disputes relating to these Terms or the Service, unless applicable law gives you a non-waivable right to bring claims elsewhere.
These Terms do not include a mandatory arbitration clause or class-action waiver.
Nothing in these Terms limits any non-waivable consumer, privacy, payment, cancellation, refund, or other statutory rights that apply to you.
21. Changes To These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice in a reasonable way, such as by posting the updated Terms, updating the date, sending an email, or showing an in-product notice.
Your continued use of ShortPulse after updated Terms become effective means you accept the updated Terms.
